Mobilicity upgrade to 21Mbps HSPA goes live with throttled service to match

Sometimes the leaks are uncannily accurate. As we'd seen just days ago, Mobilicity has flicked on its 21Mbps HSPA+ network, giving customers of the alternative Canadian carrier up to three times the speed of before if they're using new $80 Huawei E366 modem or a compatible smartphone. Unfortunately, the other part of the rumor is also true: there's now a curb on that unlimited data. Cross the (admittedly high) 6GB mark and those speeds may be throttled without springing for the 20GB that comes with either a $20 Premium Data Add-On for phones or a data-only $50 Premium Mobile Data Internet Plan. Despite the suddenly lowered ceiling, the higher performance is a welcome kick in the cellular pants for those who want a Galaxy S III without turning to one of the big three providers.

Chinese protest factory even after official pledge

NINGBO, China (AP) ? Protests against the expansion of a factory are resuming in an eastern China city despite a local government pledge to halt the project.

About 200 protesters gathered outside Ningbo government offices Monday for a fourth straight day of protests. Police channeled the crowd from the front of the building off to a side street.

The protests have occasionally featured violent clashes between protesters and police, who have detained some demonstrators. On Sunday night, the government promised to halt the expansion of the ethylene plant belonging to state-run Sinopec, though the crowd continued to protest, leaving only late in the night.

The protest, the latest on environmental issues, comes as China's authoritarian government wants calm for a transfer of power in the Communist Party leadership at a party congress that starts Nov. 8.

HUNTSVILLE, TX (10/25/12) Sam Houston State University is developing a laboratory test to detect the use of bath salts, a new designer drug that was added to the list of illegal substances by the Drug Enforcement Administration in 2011.

Sam Houston State University received a federal grant from the National Institute of Justice to create a test for key components of bath salts in biological samples in crime labs.

Bath salts, also known as synthetic cathinones, were legally sold in convenience stores, head shops and on the Internet until being included on the list of illegal substances through an emergency order by the Drug Enforcement Administration in October 2011. These drugs, that are capable of producing powerful hallucinogenic and adrenergic effects, are routinely seized in drug cases around the Houston metropolitan area and throughout the nation.

"Bath salts are the new breed of designer amphetamines, and they pose a number of challenges for law enforcement agencies from a public safety and public health standpoint," said Sarah Kerrigan, Director of the Forensic Science Program at Sam Houston State University.

According to the Drug Enforcement Administration, bath salts also have adverse effects including rapid heart rates which may lead to heart attacks and strokes, chest pains, nosebleeds, sweating, nausea, and vomiting. Those who abuse the substance also report agitation, insomnia, irritability, dizziness, depression, paranoia, delusions, suicidal thoughts, seizures, and panic attacks.

According to a 2011 report from the National Drug Intelligence Center, drug users are attracted to bath salts because they can evade most drug tests and, as a result, it may not be detected in impaired driving cases or death investigations.

"Analytical limitations for state and local forensic toxicology laboratories impact criminal and death investigation casework, and these deficiencies can have serious criminal justice consequences," Kerrigan said.

While bath salts are easy to detect in seized samples, such as pills, powders and capsules, once they are ingested, they pose a number of challenges in the toxicology lab. The Department of Forensic Science will develop a procedure to detect at least eight of the most common components found in bath salts in biological evidence. These components include mephedrone, flephedrone, methylone , butylone, ethylone, methedrone, MDPV, and naphyrone.

Many toxicology labs use gas chromatography-mass spectrometry (GC/MS) to identify drugs in biological evidence. The new study will target a wide variety of the new designer drugs using one procedure.

Amid bumper crop, families could get PB&J break

(AP) ? Choosy moms and dads may be packing more PB&J in lunches this winter, when the cost of a jar of Jif or Skippy is expected to fall even as other grocery prices rise.

Peanut butter prices soared last year after a drought and high heat in the Southeast, where most peanuts are grown. This year, that region got a break while farmers in most of the rest of the United State suffered huge losses in the widest drought in decades.

Farmers are now expected to bring in two-thirds more peanuts than they did in 2011. That could mean a price drop at the grocery store.

"After last year's small crop, we saw peanut butter prices on average rise 30 percent or more," said Patrick Archer, president of the American Peanut Council. "With this year's excellent crop, the supply and demand should come back into balance and peanut butter prices should come back to a more normal level at the retail level."

A 10 percent decrease on a $3 jar of peanut butter, for example, would translate to a savings of 30 cents. That may seem nominal, but the impact is greater for food banks and other big buyers.

Bill Bolling, founder and executive director of the Atlanta Community Food Bank, said food banks usually must buy protein-rich items like peanut butter, beans and meat. His organization buys anywhere from 200,000 to 400,000 pounds of peanut butter each year, depending on the price.

"If costs go down 10 percent or 20 percent, we can buy that much more product," Bolling said. A big supply also increases the possibility of donations ? for instance, a company may donate large shipments if there is a mistake in packaging or a huge surplus, he said.

Bolling said peanut butter is one of the most popular products at the food bank because children like it, it's high in protein and it has a long shelf life.

Peanuts are already considered a staple of the American diet, with the average U.S. consumer eating about 6 pounds of peanut butter and other peanut products each year, according to estimates from the American Peanut Council, an industry trade group. But peanut butter could become even more attractive as strong global demand, high prices for livestock feed and a huge sell-off of cattle and other animals in drought keep pushing up meat prices.

U.S. farmers are expected to produce more than 3 million tons of peanuts in 2012, according to figures released Oct. 11 by the U.S. Department of Agriculture. That's a 66 percent increase over 2011, when growers produced more than 1.8 million tons.

Experts say several factors created the perfect conditions for a banner year. High peanut prices after last year's small crop encouraged farmers to plant more; USDA figures show acreage was up nearly 50 percent in 2012 compared with a year earlier. Farmers in the Southeast also got a break in the weather. Spring came early, allowing them to plant sooner. Temperatures were generally milder, and thunderstorms in August and September provided some much-needed relief in the weeks before farmers began the peanut harvest, which is currently in full swing.

Experts also say a peanut variety developed in recent years is boosting the record yields, in part because it tends to be resistant to disease.

"In this south Georgia area, we probably had as good a growing season as I can remember in a long time, and maybe in my 26 years (as executive director)," said Don Koehler, executive director of the Georgia Peanut Commission.

Georgia by far produces more peanuts than any other state, though the legumes are grown in sandy soil from Mississippi to Florida and north to the Carolinas.

Most farmers sell a portion of their crop at a set price before they even plant, so they'll get the higher prices in effect last year for some of their product. Koehler said that should offset any losses they'll take on peanuts sold at today's lower prices, although farmers who didn't sell much in advance may have a tougher time.

"If they can hold some a little bit later, it may be that the market goes back up some point out in the future," he said.

Still, most farmers are grateful for a decent harvest after seeing some plants dry up in dusty ground last year and in some cases having to altogether abandon some acres, said Armond Morris, who farms 1,000 acres of peanuts in south Georgia's Irwin County and serves as chairman of the Georgia Peanut Commission.

"For the last two or three years, we had had some really tough years," Morris said. "A lot of things have really fallen into place (this year)."

Dissident artist Ai Weiwei goes 'Gangnam Style'

Updated at 12:42 p.m. ET: BEIJING ? Released this past summer, Korean pop star Psy's "Gangnam Style" quickly became a global phenomenon. Within months, the infectious song has been watched over 530 million times and recently earned the distinction of being the most ?liked? video in YouTube history according to the Guinness Book of World Records.

It seems that everyone has tried to get in on the Gangnam rage, including Google's executive chairman Eric Schmidt, our very own TODAY team, and just this week, United Nations Secretary-General Ban Ki-Moon.?

Ai Weiwei, China?s dissident artist who was detained last year for nearly three months, on Wednesday became the latest to jump on the Gangnam bandwagon, uploading his own version of ?Gangnam Style? on YouTube. The video, which shows Ai dancing in handcuffs, is entitled "Grass Mud Horse Style." ?

"Grass Mud Horse," a homonym of a Chinese phrase that suggests a very lewd act with one?s mother, is popular among anti-censorship activists in China.

PSY, the South Korean pop singer whose "Gangnam Style" viral video sensation made him an international star, returns to his home country, where crowds are going wild. NBC's Ian Williams reports.

Ai told journalists that the idea to cover the dance craze came from one of the many donors who helped him out last year when Ai was ordered to pay back taxes that the government claimed that he owed. Donations to help pay Ai?s government fine flooded in online and supporters even visited his studio home in Beijing to toss money over the wall to him.

YouTube is banned in China and the video has not appeared on Chinese video sites.

Foreclosures Down in September, Hit 5-Year Low | Strategic Real ...

The latest foreclosure numbers are out, and the month of September showed the lowest rate of foreclosures since July 2007. It was the second month in a row that the numbers were down, following three months of increases. Year-over-year numbers for September showed a 16% drop, with the biggest declines in the states hardest hit by the housing crisis ? California, Arizona, Michigan, Georgia, and Texas.?The biggest declines came in states where the courts don?t play a big role in the process because there was not a big backup of pending cases. In the 19 states where the courts must sign off on foreclosures, the number of foreclosure starts actually rose. Overall, the number of foreclosures is expected to slow, aside from individual state variances in how foreclosures are handled. Florida remains the state with the highest number of foreclosed homes, with one out of every 117 in some state of foreclosure.

SMWC to build $11M sports, rec center ? News ? News From Terre ...

WEST TERRE HAUTE ? Saint Mary-of-the-Woods College has launched the public phase of an $11 million fundraising campaign to build a new, 36,000-square-foot sports and recreation center.

The college kicked off the Pomeroy Pride campaign Friday with a gala fundraiser at Providence Center.

?We?re trying to build some excitement,? said Dottie King, SMWC president. ?It?s the first new building at the college in many years.?

Currently, the college doesn?t have a gymnasium on campus, she said.

The building site is tentatively planned for the west edge of campus, behind the Mary and Andy Rooney Library. It would have an NCAA regulation-sized gym seating about 1,000 spectators as well as a practice gym that could be used for intramural sports.

It also would feature a 2,000-square-foot lobby, with flexible space for functions and activities, as well as locker rooms, a training room, a fitness room and storage space.

A new facility will help recruit students, and in particular, student-athletes, who comprise 30 percent of the campus student body, King said.

It also would enable the college to add new sports, such as volleyball, and address health and wellness needs of students, faculty, staff and the community.

In addition, summer youth camps and other programs would provide revenue to the college.

SMWC has already raised $6.5 million during the quiet phase of the campaign. The goal is to raise the money and start construction as soon as possible, King said.

In the past, students used a non-regulation size gym owned by the Sisters of Providence, but it is no longer in use.

For several years, the basketball team has played its home games at a community center in Clinton. ?They?ve been very gracious to us,? King said.

But the college really wants a facility of its own and a place to play home games, she said. ?Our students never have that home game experience that we really crave to provide,? especially as part of the cross-town rivalry with Rose-Hulman Institute of Technology, King said.

Not having a gym can also make it more difficult to recruit athletes, she said. ?The first thing an athlete might want to know is, where is the gym?? she said.

The college?s athletic teams ?do amazingly well despite the fact we don?t have a gymnasium on our campus,? King said.

As a group, SMWC athletes maintain a higher grade-point average and are leaders on campus. ?These students deserve facilities that are commensurate to their achievements on the court, the field and in the classroom,? King said.

The college currently offers seven sports: basketball, cross country, golf, soccer, softball, as well as hunt seat and western equestrian teams.

A new facility, which will include a fitness room, is important in recruiting all students, not just athletes. ?It?s something students expect to find here,? King said.

All students will be able to participate in fitness and wellness programs, cheer at home games and get involved in intramural sports.

King recently read an article that indicated one of the 10 best practices to help a small, private college grow is to build a sports/recreation facility.

??It just re-energizes the campus,? King said. ?We?ve not had any new construction on this campus for so long that this building becomes for us very symbolic of moving forward.?

Deanna Bradley, SMWC athletic director and head basketball coach, said a new sports and recreation facility will help recruit athletes, but it also will be a place for all students to work out and get involved in recreational activities.

?It would be a totally different dynamic for us,? said Bradley, who is in her 22nd year as the college?s athletic director.

SMWC basketball player Whitney Allen believes the new facility ?could completely turn the campus around.?

Allen, a senior, said the team now goes to Clinton for its practice sessions and games. Team members appreciate being able to use the community center there, ?But it?s hard for people on campus to come to our games,? she said.

?Some students are busy with their own activities, and if they are from out-of-town, they may not know how to get to the Clinton facility.

?I feel we?d have a lot bigger crowd if students could just walk across campus,? Allen said. Also, the new facility will be a good motivator for all students to exercise.

While Allen won?t get to play in the new facility, she?s excited for those who will. ?I?ll watch future teams play there,? she said.

The new facility, which will have Silver LEED (Leadership in Energy and Environmental Design) certification, would also house offices for the athletic program.

U.S. deficit tops $1 trillion for fourth year

WASHINGTON (AP) ? The U.S. budget deficit has topped $1 trillion for a fourth straight year, but a modest improvement in economic growth helped narrow the gap by $207 billion compared with last year.

The Treasury Department said Friday the deficit for the 2012 budget year totaled $1.1 trillion. Tax revenue rose 6.4 percent from last year to more than $2.4 trillion, helping contain the deficit.

The government's revenue rose as more people got jobs and received income. Corporations also contributed more tax revenue than in 2011.

Government spending fell 1.7 percent to $3.5 trillion. The decline reflected, in part, less defense spending as U.S. military involvement in Iraq was winding down.

Barack Obama's presidency has now coincided with four straight $1 trillion-plus annual budget deficits ? the first in history and an issue in an election campaign that ends in Nov. 6.

Obama's Republican challenger, Mitt Romney, contends that Obama failed to achieve a pledge to halve the deficit he inherited by the end of his first term.

When Obama took office in January 2009, the Congressional Budget Office forecast that the deficit for that year would total $1.2 trillion. It ended up at a record $1.41 trillion.

The increase was due, in part, to higher government spending to fight the worst recession since the Great Depression of the 1930s Tax cuts enacted under President George W. Bush and wars in Iraq and Afghanistan contributed to the deficits.

The budget gaps in 2010 and 2011 were slightly lower than the 2009 deficit as a gradually strengthening economy generated more tax revenue. But the deficits still exceeded $1 trillion.

Obama is campaigning for a second term with a pledge to cut deficits by $4 trillion over the next decade. He says he would do so by ending the Bush-era income tax cuts for higher-income Americans and by restraining the growth of spending.

Romney has said he would cut spending growth to help narrow the budget gap. He would cap spending at 20 percent of the economy by 2016. Spending in 2012 accounted for about 23 percent of the economy.

The government borrowed about 31 cents of every dollar it spent in 2012. The string of $1 trillion-plus deficits has driven the national debt above $16 trillion. The magnitude of that figure has intensified debate in Congress over spending and taxes but little movement toward compromise.

Many fear the budget deadlock will send the economy over a "fiscal cliff" next year, when tax increases and deep spending cuts will take effect unless a budget deal is reached.

Obama wants to eliminate the income tax cuts for families that make more than $250,000.

Republicans in Congress and Romney have resisted. They argue that with the economy still weak, the government should not be raising anyone's taxes.

Congress may address the budget crisis during a lame-duck session of Congress after the November elections.

In late September, Danish professional triathlete Rasmus Henning announced that he would be retiring from professional competition following Saturday?s Ironman World Championship race. LAVA sat down with Henning to talk about his decision to retire, and how he would like to be remembered.

LAVA: When did you make the decision to retire?

Rasmus Henning: Already last winter I was pretty convinced this would be my last season. Although, at the time we were still living in the Canary Islands, and I was still very focused on my training for this season. The weather is always nice there, and so it was easy to stay motivated to train. It wasn?t until we moved back to Denmark in June that it was really set in stone.

LAVA: Was there anything in particular that made you realize it was the right time?

Henning: There were a few instances, actually, and they all kind of helped me realize that I was making the right decision. For instance, at the Abu Dhabi Triathlon, I came into the race very prepared, very focused, and I was able to take the win. It was a great day, and I though to myself, ?Should this change my mind? Should I rethink retirement? Could I still be a contender in Kona after this?? But then when I stood on top of the podium, I realized that the answer was no. I needed to move on, and retirement is the right decision. Not because I cannot perform at a top level anymore, but more because I am just ready to move on with my life in new ways. If not even winning such a huge race could change my mind, then nothing would.

LAVA: Do you have any regrets?

Henning: I actually think I am in a really good position. I have achieved almost everything I?ve ever set out to do in this sport. Obviously, I would?ve liked to have won in Kona, or to podium in the Olympics, but I?m proud of my performances, and I?m proud of who I am. I?ve achieved much more than I ever thought I was going to do. It?s given me so many great experiences and so many opportunities for the future, which I?m very grateful for. I?ve just reached a point in my life where thinking about the other things I want in life is more exciting to me than thinking about another year or two of professional competition.

LAVA: Once you decided to retire, how did it influence your training and your mental outlook for this race?

Henning: The big change happened in June when we left the Canary Islands and moved back to Denmark. Not only is the weather not as nice, and it was a rainy summer, but the whole set-up and the logistics of training were just way more complicated than they were in Spain. Everything there was focused around me and my training. Whereas in Denmark, my wife started working, my kids were back in school, and everything is in different places so I was spending a lot more time and effort just getting from place to place. Also, there is just a lot more to do in Denmark. In the Canary Islands, apart from training and spending time with my family, there wasn?t much to do. We have so many friends and family members in Denmark, and so there were a lot more things I wanted to do and time I wanted to spend with them. I think I reached a point where missing out on that just doesn?t make sense to what my goals are. The value of my goals has diminished, which kind of sums everything up.

LAVA: When a professional triathlete decides to retire, what exactly is involved? Who did you tell first and how did that process all go down?

Henning: It has been a long process with my family. I?ve been talking it over with my wife, and the other people closest to me for some time. My manager, my coach and my wife kind of had to discuss the best way to announce it, and more importantly when to announce it. We didn?t know if we should wait until after Kona. But then we realized that not telling everyone was putting me under a lot of pressure. I don?t like being dishonest with anyone. I hated that part for the past few months; having to talk about my future plans in racing with people and that kind of thing. I still had to tell people stories about next season and whether or not I would be in the Canary Islands, and I really hated being dishonest with people. So we decided to announce it. It was a big relief. Everyone has really responded to it very well, and that has been great for me. I?m happy to be able to make this decision before I?m too old, too injured or too weak to perform.

LAVA: What about your retirement is most appealing to you right now?

Henning: Well, I?m excited to not have those long travels away from my family. I?m likely to keep myself very busy, and I have other goals, but I always want to make sure I can be there more for my family. I look forward to not absolutely having to go out and do a lot of hard training no matter how I feel, or no matter what the weather is outside. I am looking forward to just enjoying it. I think I will actually still train quite a lot, but I will just look at it differently.

LAVA: Do you have any projects in the works?

Henning: Yes, I?ll be starting up a business, which is very much triathlon-related. I want to focus more on the Scandinavian market. It will be called TriNordic. I will be doing a lot of public speaking, training seminars and training camps and that type of thing. And we will also be selling some products, which should be pretty exciting.

LAVA: If you had to sum yourself and your career up in a few sentences, what would those be?

Henning: I would like to be remembered as a good, strong athlete who could perform very well on his best days, but also a guy with a lot of integrity and loyalty. That is how I would like to be remembered.

Long before the current rash of fungal meningitis, the compounding pharmacy suspected in the outbreak settled a lawsuit alleging it produced a tainted shot that caused a man's death in 2004.

Earlier this summer, a separate pharmaceutical firm with common owners was accused of failing to separate sterile and non-sterile supplies. That pharmaceutical company was shut down Wednesday for inspections, the latest example of fallout from the growing outbreak.

Officials have identified Framingham, Mass., based-New England Compounding Center as the source of steroid shots suspected in the outbreak of rare fungal meningitis that has killed at least 12 people and made more than 130 others sick in 10 states.

Allegations that a shot tainted with bacteria caused a man to contract a different form of meningitis were at the heart of a lawsuit filed against the company over the 2004 death. An 83-year-old man died about a year and a half after receiving a shot produced by the company.

Another drug company that has some of the same owners, Ameridose LLC, agreed to temporarily stop its compounding and manufacturing operations as a precaution while regulators inspect its facilities, but the measure is being done as a precaution, not because of evidence of contamination, officials said Wednesday. Ameridose, based in Westborough, Mass., was accused by a business customer this year of failing to separate sterile and non-sterile products in its warehouse.

Andrew Paven, a spokesman for both companies, said: "Ameridose is a separate entity from New England Compounding Center, with distinct operational management."

"We have separate production facilities, separate processes and operate at separate locations in different cities. Although there is common ownership, the two companies operate under separate registrations and different licensure," the statement from Paven said.

On Wednesday, Massachusetts Gov. Deval Patrick said the New England Compounding Center may have misled regulators and done work beyond the scope of its state license. The company was licensed to fill specific prescriptions for specific patients but exceeded that, he said.

"What they were doing instead is making big batches and selling them out of state as a manufacturer would, and that is certainly outside of their state license," he said.

A company spokesman declined comment on Patrick's assertion beyond a statement that company officials are focused on cooperating with the investigation. The company has shut down operations and recalled the fungus-contaminated steroid.

A 2004 lawsuit filed in upstate New York's Monroe County claimed New England Compounding Center produced a tainted shot that caused William Koch to contract bacterial meningitis at Rochester General Hospital on July 17, 2002. Koch died Feb. 28, 2004, at the age of 83.

The lawsuit said the shot was the source of Koch's meningitis, but did not explain how that determination was made.

Bacterial meningitis is contagious and much more common than the fungal meningitis involved in the current outbreak. Fungal meningitis is more difficult to catch, according to the Centers for Disease Control and Prevention.

The compounding pharmacy reached a settlement with Koch's widow in 2007 before the case went to trial, according to her lawyer Mark S. Nunn. He declined to elaborate Wednesday because the terms were confidential.

"Really all I can say is that the case settled prior to trial," Nunn said.

Two of the people who founded New England Compounding Pharmacy Inc. in 1998 ? Gregory Conigliaro and Barry Cadden ? formed Ameridose in 2006, according to documents filed with the Massachusetts Secretary of State's office. The company's website says it provides hospitals around the country with products including intravenous solutions and prefilled oral syringes of painkillers and other medications.

This summer, an organization that represents hospitals in purchasing deals with drug suppliers cancelled a contract with Ameridose over allegations that it had poor quality control practices that "rose to a level of concern for patient safety," according to a lawsuit that Ameridose filed in August.

Ameridose denies those allegations and filed a defamation and slander lawsuit in U.S. District Court in Massachusetts on Aug. 8, saying Novation LLC hurt its reputation by making allegations including that there was "no separation between sterile and non-sterile products" in an Ameridose warehouse.

The lawsuit doesn't say what the products were or elaborate on how they were stored. Novation declined to release a copy of its report.

Novation, which leverages hospitals' combined buying power to get better prices on medical goods, sent two employees to audit Ameridose on July 15 and terminated its contract, the lawsuit said.

"Novation has determined that Ameridose does not meet the quality systems requirements needed to maintain a Novation agreement," Novation told its members in an Aug. 2 newsletter, according to the lawsuit.

Ameridose strongly objected to the allegations and said in its defamation lawsuit that the Novation auditors were unqualified and made false and misleading statements. Ameridose also said it had been audited in recent years by several other organizations that determined its quality control system "meets or exceeds their high quality standards." Ameridose is regulated by the U.S. Food and Drug Administration.

The lawsuit ended in a confidential settlement Sept. 24.

Paven, the Ameridose and New England Compounding Center spokesman, said Wednesday in his email that the "suit involved contractual commercial issues between the companies that have since been resolved."

A statement from Novation said that while it "vigorously disputed each and every claim made in the lawsuit, the parties ultimately agreed to settle the lawsuit."
